Allergen and Food Safety Disclosure

Teal Penguin Kitchens is a home-based food producer as allowed under the 2012 Colorado Cottage Foods Act.  The purpose of this document is to gain your confidence and trust that foods we are producing are safe and as free from allergens as we can make them.  Though our operation is small, we follow as many standards and regulations of a commercial kitchen as possible.

  1. Our food production area is located in a finished basement with a single point of access.

  2. FDA registration #15824985098

  3. We use no “potentially hazardous” ingredients i.e. raw and cooked meat, dairy products, seafood, and processed fruits and vegetables that would require USDA registration.

  4. We meet as many commercial kitchen standards as possible:

    • FDA Food Safety Modernization Act (FSMA)

    • FDA 21 CFR 117 Current Good Manufacturing Practices

    • Hazard Analysis and Critical Control Point (HACCP) Plan

    • NSF-certified Equipment

  5. Jeannine and Rick have received the State Food Safety Food Handler and Allergen certifications.

  6. Rick has a culinary degree and understands food handling and safety procedures that are followed in a commercial kitchen such as HACCP, process logging, etc.

  7. Jeannine has worked in a commercial kitchen and was responsible for food safety inspections that complied with HACCP and county health department regulations.

  8. None of the nine food allergens are ever present in the production room.

  9. All ingredients we source are free from the top nine food allergens as stated by our suppliers.

  10. Our ingredients are received at a staffed pickup location so that it is not sitting unattended on a porch.

  11. The raw ingredients are stored in their original packaging or commercial food storage containers.

  12. All food contact surfaces are cleaned and sanitized before production.

  13. Dedicated utensils are used to draw raw ingredients from their storage containers.

  14. Reverse osmosis filtration for the water.

  15. Disposable gloves, hair restraints, aprons, and other personal attire are worn during production.

  16. Separate hand-washing and commercial ware-washing sinks.

  17. Finished product is packaged immediately after production.

  18. All finished product is stored on dedicated shelving in a cool, dry storage area.

  19. Shipped product is taken directly to a staffed shipping facility.

  20. All food contacts surfaces, equipment, and utensils are cleaned immediately after production.

  21. All cleaning and pest control chemicals are stored away from the production room.

  22. There are no pets in the home.

As we are currently a cottage food business, we are required to put the following disclosure on all of our products:

“This product was produced in a home kitchen that is not subject to state licensure or inspection and that may also contain common food allergens such as tree nuts, peanuts, eggs, soy, wheat, milk, fish and crustacean shellfish. This product is not intended for resale.”

However, as previously stated, we are doing everything we can to make sure that our snack food is allergen friendly.

“Nearly half (49.3%) of all food recalls in 2023 were due to undeclared allergens on product packaging” which was from certified production facilities. Our operating practices have to be flawless because Jeannine’s life depends on it!
